These Terms of Service ("Terms") govern your use of Silver Gamers website located at silvergamers.com (the "Service") operated by Silver Gamers ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

1. Eligibility

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Subscription Services

3.1 Membership Tiers

We offer the following membership tiers:

  • Reader (Free): Limited access to content and features
  • Silver Member (£5/month or £50/year): Full content access, community features, and entry to monthly gaming quiz
  • Founding Member (£25/month or £250/year): Premium benefits, exclusive content, and double entries to monthly gaming quiz

All prices include VAT where applicable.

3.2 Billing and Renewal

  • Subscriptions automatically renew unless cancelled before the renewal date
  • We use Stripe for payment processing
  • We will provide at least 30 days notice of any price changes
  • Founding Members receive legacy pricing protection
  • You will receive email confirmation of all charges

3.3 Your Cancellation Rights

14-Day Cooling-Off Period

Under the Consumer Contracts Regulations 2013, you have the right to cancel your subscription within 14 days of purchase without giving any reason. However, if you access our digital content during this period, you acknowledge that you will lose this cancellation right.

Ongoing Cancellation Rights

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of your current billing period.

3.4 Our Cancellation Rights

We may cancel your subscription with 30 days notice, unless immediate cancellation is required due to:

  • Breach of these Terms
  • Fraudulent activity
  • Legal requirements

3.5 Refunds

While we do not generally offer refunds for partial subscription periods, we will consider refund requests on a case-by-case basis, particularly where:

  • Technical issues prevent access to the Service
  • We fail to provide the advertised features
  • Required by law

4. Content and Intellectual Property

4.1 Our Content

All content on Silver Gamers, including text, graphics, logos, images, audio clips, and software, is the property of Silver Gamers or its content suppliers and is protected by UK copyright laws and international treaties.

4.2 Your Use of Our Content

You may:

  • View and access content for personal, non-commercial use
  • Share links to our content
  • Print individual articles for personal use
  • Make limited quotes with attribution for non-commercial purposes

You may NOT:

  • Reproduce, distribute, or create derivative works from our content without permission
  • Use our content for commercial purposes without written permission
  • Remove any copyright or proprietary notices
  • Use automated tools to scrape or download content in bulk

4.3 User-Generated Content

By posting comments or other content on our Service, you:

  • Grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content
  • Retain ownership of your content
  • Represent that you own or have the necessary rights to such content
  • Agree that your content does not violate any third-party rights
  • Understand we may moderate or remove content that violates our Community Guidelines

5. Prohibited Activities

6. Monthly Gaming Quiz

6.1 Member Exclusive Benefit

The Monthly Gaming Quiz is an exclusive benefit for paid members (Silver and Founding tiers). This is a game of skill where members answer gaming-related questions to win prizes.

6.2 How It Works

  • Quiz questions are sent via the member newsletter
  • Members with correct answers are entered into a random draw
  • Silver Members receive 1 entry; Founding Members receive 2 entries
  • Typical prizes range from £10-20 in value

6.3 Eligibility

Open to members residing in the UK, EU, US (where permitted), Canada, Australia, and New Zealand. Full terms and conditions are available in our Monthly Gaming Quiz Terms.

The Monthly Gaming Quiz is a game of skill and complies with applicable laws. It is not gambling or a lottery.

Our Service may contain links to third-party websites or services that are not owned or controlled by Silver Gamers. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

8. Disclaimers

8.1 Service Availability

While we strive to provide continuous access to our Service:

  • We do not guarantee uninterrupted availability
  • We may perform maintenance with reasonable notice
  • We are not liable for issues beyond our reasonable control

9.3 Subject to section 9.1, our total liability to you in respect of all losses arising under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Silver Gamers, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your violation of any law or third-party rights
  • Content you post on our Service
